1. Agreement to Terms

By accessing Lumin8 Content Marketing (“Lumin8,” “we,” “us,” or “our”) at lumin8content.com or engaging our services, you agree to be bound by these Terms and Conditions. If you disagree with any provision, please do not use our website or purchase our services.

These terms govern your use of our website and your purchase of any services offered by Lumin8 Content Marketing, a sole proprietorship operating under the trade name “Lumin8 Content Marketing” in Huntington Beach, Orange County, California, USA.

2. Services Overview

Lumin8 provides research-driven content marketing services for independent authors, including but not limited to:

  • Marketing audits and analytics interpretation
  • Content creation (blog posts, newsletters, email copy, social media)
  • Strategic consulting and discovery sessions
  • Website and landing page optimization
  • Discoverability assessments (SEO/GEO/AEO)

All services are performed by human professionals with decades of editorial and marketing experience. We never use AI-generated content, strategies, or tactics with our clients.

3. Intellectual Property Rights

3.1 Client Ownership

Upon full payment of all fees, you (the client) receive exclusive ownership of all final content created specifically for you, including blog posts, emails, newsletters, landing pages, and strategy documents.

3.2 Lumin8 Retained Rights

Lumin8 retains all rights to:

  • Underlying research, data, methodologies, and analytical frameworks
  • Templates, tools, and systems used to create deliverables
  • General knowledge and industry expertise
  • Proprietary processes and optimization techniques

3.3 Portfolio Display

You grant Lumin8 the right to display completed work in our portfolio, case studies, and marketing materials unless you opt out in writing at the time of service initiation. We will not disclose your work without permission if you request anonymity.

4. No Refund Policy

4.1 Final Sales

All purchases are final. Lumin8 does not issue refunds under any circumstances. Payments submitted through our website, via Stripe, PayPal, or any other payment processor are non-refundable.

4.2 Payment Structure

All services require full payment upfront before work commences. There are no deposits.

  • For À La Carte Services: Full payment is due at the time of purchase. Work will not begin until payment clears.
  • For Retainer Packages (Growth/Authority): Retainer packages are paid in full for the minimum 3-month commitment at the start of the billing cycle. Cancellation Within 14 Days: If you cancel a retainer within the first 14 days, we will refund all but one month’s fees. (Example: If you paid $2,247 for 3 months, you’d receive $1,498 back, and $749 would be retained.) After the 14-day window closes, all payments are final and non-refundable.
  • Payment Plans: Available on select packages on a case-by-case basis. If approved for a payment plan, a binding agreement outlines the payment schedule. Missed or late payments may result in service suspension until the account is current.

All payments are final and non-refundable per our No Refund Policy (Section 4), subject to the 14-day cancellation window described above.

4.3 Payment Plan Terms

For clients enrolled in payment plans:

  • Previous payments will not be refunded if you cancel or pause
  • Your project will be paused or discontinued until payments resume
  • Upon cancellation, previously rendered work remains your property, but future deliverables will cease

4.4 No Chargebacks

By making payment to Lumin8, you agree not to request a refund through any financial institution or charge your payment method. You will not seek punitive or financial actions against Lumin8 Content Marketing based on dissatisfaction with services rendered.

5. Payment Terms

5.1 Pricing and Invoicing

All fees are listed in U.S. Dollars (USD). Prices are subject to change without notice for new customers. Existing retainer clients will receive 30 days’ written notice of any price adjustment.

5.2 Late Payment Fee

Payments received more than 14 days after the due date will incur a 15% late fee. Outstanding invoices may result in suspension of services until payment is received.

5.3 Accepted Payment Methods

Lumin8 accepts payment through Stripe, PayPal, and other secure payment processors as listed on our website. All transactions are processed securely with SSL encryption.

5.4 Taxes

You are responsible for any applicable sales tax, VAT, or other taxes related to your purchase. Lumin8 will collect and remit taxes where legally required.

6. Service Delivery and Timelines

6.1 Turnaround Time Definition

Our turnaround time begins only after we have received all required information, access, and materials from you. If you delay providing necessary inputs (login credentials, manuscript files, brand guidelines, feedback), your project timeline will be extended accordingly with no penalty to Lumin8.

6.2 Revision Process

Clients receive one round of revisions on standard deliverables unless otherwise specified. Unlimited revisions are included only in Growth and Authority package retainers. Additional revision rounds may incur fees at our discretion.

6.3 Project Delays and Abandonment

If a project remains inactive due to lack of client communication or feedback for 90 days from your initial payment:

  • The project will be considered cancelled
  • Previously paid amounts are non-refundable
  • To resume work, a project restart fee of $150 applies
  • All timelines reset based on available scheduling

6.4 Implementation Support

For audit-based services, recommendations are delivered in written format. The “Fix It For You” add-on is available for hands-on implementation at additional cost.

7. Disclaimer of Guarantees

7.1 No Outcome Promises

Lumin8 does not guarantee specific sales figures, bestseller rankings, revenue outcomes, traffic numbers, or conversion rates. Marketing results depend on numerous factors beyond our control, including:

  • Market conditions, tariffs, and competition
  • Book quality and genre dynamics
  • Timing and seasonal trends
  • Platform algorithm changes
  • Client execution of recommendations

7.2 Research-Based Strategies

While our strategies are built on peer-reviewed research spanning 3,800+ indie authors and 50,000+ titles analyzed, individual results vary. Past performance of our case studies does not predict future results for your specific project.

8. Limitation of Liability

8.1 Third-Party Services

Lumin8 maintains zero liability for issues originating from third-party software providers, including but not limited to:

  • Hosting platforms (e.g., SiteGround, WordPress)
  • Analytics tools (Google Analytics, Search Console)
  • Email service providers (Mailchimp, ConvertKit, Mailerlite)
  • Payment processors (Stripe, PayPal)

If any third-party service experiences downtime, data loss, or security breaches, Lumin8 is not responsible for resulting disruptions to your marketing activities.

8.2 Data Breaches

We employ industry-standard security measures to protect your information. However, we cannot guarantee absolute security of data transmitted over the internet. By using our services, you accept this inherent risk.

8.3 Consequential Damages

To the fullest extent permitted by California law, Lumin8 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if advised of the possibility of such damages.

8.4 Liability Cap

Our total liability for any claims related to your purchase of services shall not exceed the amount you paid to Lumin8 for the specific service giving rise to the claim.

9. Client Responsibilities

9.1 Accurate Information

You agree to provide accurate, complete, and timely information necessary for us to perform our services. Misrepresentation of facts may result in service termination without refund.

9.2 Compliance

You are responsible for ensuring that any content you provide or approve complies with applicable laws, including copyright, trademark, and defamation regulations. Lumin8 shall not be liable for legal disputes arising from your content.

9.3 Account Access

You must provide timely access to required platforms (website CMS, email service, analytics) when requested. Delays caused by access issues will extend project timelines.

9.4 Approval Process

You acknowledge that delays in approving drafts or providing feedback will extend delivery schedules without additional charges to you.

10. Termination

10.1 Client Cancellation

You may cancel ongoing services at any time by providing 30 days’ written notice. All payments made prior to cancellation are non-refundable, except as provided in Section 4.2 (14-day cancellation window for retainer packages). Work completed to the cancellation date will be delivered.

10.2 Lumin8 Termination

We reserve the right to terminate services if:

  • You breach any term of these agreements
  • Payment is overdue more than 30 days
  • Your project becomes legally problematic or ethically compromising

Upon termination by Lumin8, any prepaid but undelivered service amount will be refunded proportionally.

11. Confidentiality

Both parties agree to keep confidential any proprietary information disclosed during the engagement. This obligation survives termination of services for a period of two years.

12. Privacy

Your privacy is important to us. Our Privacy Policy (separate document) explains how we collect, use, and protect your personal information. By using our services, you consent to the practices described therein.

12.5 California Consumer Privacy Act (CCPA) Notice

California residents have rights under the CCPA, including the right to:

  • Know what personal data is collected, used, shared, or sold
  • Delete personal data held by us
  • Opt-out of the sale of personal information
  • Receive equal service and pricing regardless of privacy choices

We do not sell personal information. To exercise these rights, contact us within 45 days for response.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict of law principles. Any legal action or dispute arising from these terms or our services shall be brought exclusively in the courts of Orange County, California.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised terms.
